How to Cancel a Timeshare or Holiday Club in Turkey and Get Your Money Back - Consumer Law guide cover image

A timeshare in Turkey, or a holiday club membership, is often sold after a "free holiday" or "free dinner" presentation, with a card payment taken on the same evening. Turkish consumer law has strict rules for cancelling these contracts, and since 2022 they give buyers more ways out than many sellers mention.

If you have a matter on this topic:

1. Timeshare, timeshare ownership or holiday club: what did I buy in Turkey?

Turkish law separates several products that are often sold together under one brand:

ProductWhat it givesBasis
Timeshare (devre tatil) as a personal rightOvernight stays for more than one period over more than one year, under a contract6502 Art. 50/1
Timeshare ownership (devre mülk)A share in the property with the right to use it in set periods, registered at the land registryCondominium Law Arts. 57-58
Long-term holiday service (holiday club)Discounts or other benefits on accommodation, travel or services for more than one year6502 Art. 50/3
Exchange contractMembership of a system for swapping weeks6502 Art. 50/4
Resale contractA company's help in selling an existing timeshare6502 Art. 50/4
Turkish Condominium Law Articles 57 and 58 in Turkish: devre mulk timeshare ownership as a servitude attached to a co-ownership share, transferable and inherited
Condominium Law Articles 57-58: timeshare ownership (devre mülk) is tied to a registered share, can be transferred and passes to heirs (Source: mevzuat.gov.tr) [M2]

Timeshare ownership on the title deed

A timeshare ownership share is registered at the land registry, can be transferred and passes to heirs (Condominium Law Art. 58), each period must be at least seven days, and unless the contract says otherwise the holder may let others use it (Art. 59) [M2]. A personal-right timeshare or holiday club, by contrast, exists only as a contract.

2. Timeshare cooling-off period in Turkey: can I cancel within 14 days?

Yes. The consumer may withdraw from timeshare, holiday club, exchange and resale contracts within 14 days without giving any reason and without paying a penalty (6502 Art. 50/6; Regulation Art. 7) [M1] [M3]. This 14-day window is what English-speaking buyers usually call the cooling-off period. Since the 2022 amendment this also covers contracts giving timeshare ownership (devre mülk) [M1].

Consumer Protection Law Article 50/6: 14 days to withdraw, no payment during that time, immediate refund (Source: mevzuat.gov.tr) [M1]
QuestionRule
How is notice given? For personal-right timeshares, in writing or on a durable medium (such as email); for timeshare ownership, through a notary (Regulation Art. 8/1)
Is there a form? The seller must give the cancellation form (Annex 6) when the contract is made; a clear statement of withdrawal is also enough (Art. 8/2-3)
What happens to related contracts?Resale, exchange and all related contracts end automatically, without penalty (6502 Art. 50/6; Regulation Art. 8/4)
Can the seller charge for services used before withdrawal? No (Regulation Art. 9/2)
When is money returned for timeshare ownership?Within 14 days after the notice reaches the seller, together with any debt documents (Regulation Art. 9/3)

No. Until the withdrawal period ends, the seller may not ask the consumer to make any payment under any name, or to sign any document creating a debt. If money is taken anyway, it must be refunded immediately, and any debt document is invalid for the consumer (6502 Art. 50/6; Regulation Art. 9/1) [M1] [M3]. This rule applies whether the money was described as a deposit, a booking fee, an administration fee or a first instalment.

Services used before cancelling

A consumer who withdraws cannot be charged for services provided before the withdrawal, such as nights already spent during a presentation stay (Regulation Art. 9/2) [M3].

4. "Free holiday" and "free dinner" invitations

Where a seller invites a consumer using sales incentives such as a gift holiday, campaign, free meal or trip, the content of the invitation and its commercial purpose must be told to the consumer in writing or on a durable medium before the presentation (Regulation Art. 5/5). The seller must prove that it did so (Art. 5/6) [M3].

5. More than 14 days have passed: can I still cancel?

Possibly. The law makes the seller's information duties the condition for the short time limit:

Seller's dutyBasis
A pre-contract information form, at least one day before the contract6502 Art. 50/4; Regulation Art. 5/1
Required content of the form (Annexes 1-4), in at least 12-point typeRegulation Art. 5/2-3
A contract with the required content, and a copy given to the consumerRegulation Art. 6/1
The cancellation form given when the contract is madeRegulation Art. 8/2

If the seller breached these duties, the consumer is not bound by the 14-day limit; the right then ends in any case one year after the 14-day period would have ended. If the seller fulfils the duties within that year, the 14 days start from that date (Regulation Art. 10) [M3].

Who has to prove what was given

The seller must prove that a copy of the contract was given (Art. 6/4), and the consumer must write the contract date in his or her own handwriting and sign it (6502 Art. 50/5; Regulation Art. 6/3) [M1] [M3].

Timeshare Regulation Articles 10-13: up to one year for incomplete information, linked credit, annual instalments and cancellation from the third year (Source: mevzuat.gov.tr) [M3]

6. I paid with a bank loan: does the loan end too?

If the price is financed by a lender under an agreement with the seller, and the withdrawal notice is also sent to the lender within the withdrawal period, the linked loan ends without compensation or penalty (6502 Art. 50/7; Regulation Art. 11/1) [M1] [M3]. The linked loan takes effect only at the end of the withdrawal period (Regulation Art. 11/2), and notice to the lender is given in the same way as to the seller (Art. 11/3) [M3].

7. Holiday club in Turkey: how to stop paying

Rule for long-term holiday service contractsRegulation
Payments, including membership fees, must be split into equal annual instalments; terms allowing payment outside that plan are invalidArt. 12/2
The seller must send a payment notice at least 14 days before each paymentArt. 13/1
After paying the first two instalments, from the third year the member can end the contract within 14 days of receiving each payment notice, without penaltyArt. 13/2

8. I don't want to use my timeshare this year: do I still pay the fees?

For a timeshare that gives a personal right, a consumer who tells the provider in writing or on a durable medium at least 90 days before a holiday period that it will not be used cannot be charged for that period under any name, such as the annual share of expenses, maintenance fees, participation fees or general administrative costs (6502 Art. 50/10; Regulation Art. 17/A) [M1] [M3]. This rule also applies to personal-right timeshare contracts made before the 2022 changes (Regulation, Provisional Art. 1) [M3].

9. How long can a timeshare contract last, and can it be prepaid?

RuleBasis
Timeshare contracts, except those giving timeshare ownership, can be made for at most ten years6502 Art. 50/9
Prepaid timeshare contracts, including timeshare ownership, cannot be made with consumers6502 Art. 50/8
Timeshare rights cannot be given through membership of a cooperative, company, association or foundation6502 Art. 50/2
A person who holds no real right over the property cannot sell timeshares in it6502 Art. 50/2
A real right tied to an ownership share can only be given through timeshare ownership under the Condominium Law6502 Art. 50/2

A transitional rule allowed, for five years from the 2022 amendment, sales in projects that already had a building permit at that time, including prepaid sales and the older structures (6502, Provisional Art. 3/2) [M1]. Whether a particular contract falls under the new rules or the transition therefore depends on the date of the contract and the project.

10. My contract was signed before 2022: which rules apply?

As a rule, a consumer transaction is governed by the law in force when it was made, but provisions of open-ended consumer contracts that conflict with the 2022 law no longer apply from its entry into force (6502, Provisional Art. 3/1) [M1]. For timeshares, the regulation in force at the date of the contract applies, together with the new 90-day rule on unused periods (Regulation, Provisional Art. 1) [M3].

11. Selling my timeshare in Turkey: resale companies and fees

A timeshare ownership share can be transferred and passes to heirs (Condominium Law Art. 58) [M2], so it can be sold through the land registry like other property shares. A company that helps sell a timeshare under a resale contract cannot ask for payment until the sale actually takes place (Regulation Art. 9/5) [M3]. Requests for upfront "marketing", "valuation" or "registration" fees in return for a promised buyer are a frequent feature of complaints, and a resale contract also comes with the 14-day withdrawal right (6502 Art. 50/4, 50/6) [M1].

12. "Non-refundable" and waiver clauses

Any clause in the contract or in a separate document by which the consumer waives rights under the regulation, or which limits or removes the seller's obligations, is invalid (Regulation Art. 17) [M3]. Unfair terms in standard consumer contracts are void, and the other terms remain valid (6502 Art. 5) [M1].

13. Where to complain about a timeshare company in Turkey

An application can be made where the consumer lives or where the transaction took place (Art. 68/3), and a consumer court case can also be filed where the consumer lives (Art. 73/5) [M1]. For a holidaymaker who signed in a resort town, the place of the transaction is that town. The same bodies are explained in our article on car rental accidents in Turkey.

16. Consumer rights lawyer in Istanbul, Ankara and across Turkey for timeshare disputes

Timeshare disputes go to the Consumer Arbitration Committee or consumer court where the consumer lives or where the contract was made, and timeshare ownership cases involving the title deed go to the court where the property is located. Buyers living in İstanbul often look for a consumer rights lawyer in Istanbul; contracts signed in the capital are followed by a lawyer in Ankara; and holidaymakers who have gone home usually act through a lawyer in Turkey with a power of attorney.

How do I cancel a timeshare in Turkey?

For personal-right timeshares, by notice in writing or on a durable medium such as email; for timeshare ownership (devre mülk), through a notary (Regulation Art. 8/1). The seller's cancellation form or a clear statement can be used.

More than 14 days have passed. Can I still cancel?

If the seller did not give the pre-contract information form at least a day before, the contract copy or the cancellation form, the 14-day limit does not apply; the right ends at the latest one year after the 14 days would have ended (Regulation Art. 10).

What is the difference between devre mülk and devre tatil?

Devre mülk is timeshare ownership registered at the land registry, tied to a property share, transferable and inherited (Condominium Law Arts. 57-58). Devre tatil as a personal right exists only as a contract.

What is a holiday club contract under Turkish law?

A long-term holiday service contract: for more than one year it gives discounts or other benefits on accommodation, travel or services (Consumer Protection Law Art. 50/3).

How do I stop paying for a holiday club in Turkey?

Payments must be equal annual instalments; after the first two, from the third year the member can end the contract within 14 days of receiving each payment notice, without penalty (Regulation Arts. 12-13).

My timeshare was financed with a bank loan. Does the loan end if I cancel?

If the loan is linked to the seller and the withdrawal notice is also sent to the lender within the period, the loan ends without compensation or penalty (Art. 50/7; Regulation Art. 11).

Do I have to pay maintenance fees if I don't use my timeshare week?

How long can a timeshare contract last in Turkey?

Timeshare contracts, except timeshare ownership, can be made for at most ten years (Consumer Protection Law Art. 50/9).

Are prepaid timeshare contracts allowed in Turkey?

No. Prepaid timeshare contracts, including timeshare ownership, cannot be made with consumers (Art. 50/8), subject to a five-year transition for projects that had a building permit when the 2022 amendment was published (Provisional Art. 3/2).

Can a timeshare be sold through club or company membership?

No. Timeshare rights cannot be given through membership of a cooperative, company, association or foundation, and a person without a real right over the property cannot sell timeshares in it (Art. 50/2), subject to the transitional rule.

I was invited to a free holiday presentation. Does that matter?

If a seller uses a gift holiday, free meal or trip to invite consumers, the content and commercial purpose of the invitation must be disclosed in writing before the presentation, and the seller must prove it (Regulation Art. 5/5-6).

A resale company asked me for a fee to sell my timeshare. Is that allowed?

Under a resale contract, the seller cannot ask the consumer for payment until the sale actually takes place (Regulation Art. 9/5).

Can I sell my devre mülk?

Yes. Timeshare ownership is transferable and passes to heirs (Condominium Law Art. 58), so it can be sold through the land registry.

When do I get my money back after cancelling timeshare ownership?

My contract says payments are non-refundable. Is that valid?

Clauses by which the consumer waives rights under the regulation, or which limit the seller's obligations, are invalid (Regulation Art. 17), and unfair terms are void (Consumer Protection Law Art. 5).

I signed before 2022. Do the new rules apply?

As a rule the law in force at the time applies, but the 90-day rule on unused periods also applies to older personal-right timeshares, and conflicting provisions of open-ended consumer contracts no longer apply (Regulation Provisional Art. 1; Law 6502 Provisional Art. 3/1).

Where do I complain about a timeshare company in Turkey?

For disputes below TRY 186,000 in 2026, to the Consumer Arbitration Committee where you live or where the contract was made; above that, to the consumer court after mediation (Arts. 68, 73, 73/A).

I signed in a resort town and live abroad. Where can I apply?

An application to a Consumer Arbitration Committee can be made where the transaction took place (Art. 68/3), which for a holidaymaker is usually the town where the contract was signed.

Must I write the date by hand on a timeshare contract?

Yes. Except for distance contracts, the seller must ensure the consumer writes the contract date in his or her own handwriting and signs (Art. 50/5; Regulation Art. 6/3).

What is the minimum period for timeshare ownership?
