
Time Limits in Individual Applications and Their Assessment in the Framework of the Right of Access to Court

The thirty-day filing period for individual applications to the Constitutional Court is one of the admissibility conditions examined before the merits. Questions of when the period begins to run, when it is suspended and how it is calculated cause a significant number of applications to be rejected for being out of time.
This study examines the time-limit rule in the light of the Constitutional Court's case law, addressing the criteria for the starting point of the period, its relationship with the exhaustion of ordinary remedies, and exceptional situations. The analysis is conducted within the framework of the right of access to court guaranteed by Article 36 of the Constitution and Article 6 of the European Convention on Human Rights.
