Turkey Overstay Penalty and Entry Ban Calculator 2026
A foreign national who remains in Turkey after a visa, visa-free stay or residence permit has expired may face an entry ban depending on the length of the overstay and how they leave (Article 9 of Law No. 6458). Fine: On departure, the residence permit fee for the overstay period is collected at double the amount, without any additional penalty or late interest (Fees Act No. 492, Tariff No. 6). The fee depends on nationality, so this tool does not calculate an amount. Even after an entry ban expires, entry is refused while administrative fines or other public debts remain unpaid. Entry Ban Periods for Visa and Residence Overstays (2026)
According to the Migration Directorate's statement of 9 June 2020, entry bans imposed on foreign nationals who overstay a visa, visa exemption, residence permit, work permit or work permit exemption fall into three groups. Which group applies depends on the length of the overstay, whether the person leaves of their own accord or under a deportation decision, and whether they pay the fine arising under the Fees Act (Law No. 492). The periods are shown in the table below.
The maximum statutory length of an entry ban is five years; where there is a serious threat to public order or public security, it may be extended by up to ten more years (Article 9/3 of Law No. 6458). Bans imposed on public order, public security or public health grounds are not set by the length of the overstay; this tool only covers bans that depend on the overstay period.
Is There an Entry Ban for an Overstay of Less Than 3 Months?
No entry ban is imposed on a foreign national whose overstay is shorter than 3 months (3 months not included) and who goes to the border of their own accord before being detected and pays the fine under the Fees Act. The same applies to a person who receives a deportation decision, leaves within the time given and pays the fine. A person who does not pay, however, faces a 3-month ban even if the overstay was shorter than 3 months.
How Is the Overstay Fine Calculated?
The amount payable on departure is calculated under Tariff No. 6 attached to the Fees Act: where no residence permit was obtained or it was not extended, the residence permit fee for the overstay period is collected at double the amount, without any additional penalty or late-payment interest. The residence permit fee itself varies by country on the basis of reciprocity, which is why the tool does not calculate an amount.
According to the Migration Directorate's 2026 statement, citizens of Czechia, Denmark, Ireland, Kosovo, Nepal, Sri Lanka, Syria, Turkmenistan, the TRNC and Palestine are exempt from the residence permit fee. The residence permit card fee for 2026 is TRY 964, and no nationality is exempt from it.
What Happens If You Do Not Pay the Fine?
A foreign national who leaves without paying faces an entry ban of 3 months to 5 years depending on the length of the overstay. According to the Migration Directorate, even after the ban expires, entry is refused while unpaid administrative fines and other public debts remain outstanding. A visa is not issued to a person who refuses to pay debts arising from a visa violation (Article 15/1-ğ of Law No. 6458), and governorates may make admission subject to prior permission on this ground (Article 9/7).
Entry Ban After Leaving Under a Deportation Decision
A foreign national whose overstay is 3 months or longer and who is invited to leave under a deportation decision faces an entry ban of 6 months to 5 years, whether or not the fine is paid. The same table applies to those who do not leave within the time given after a residence or work permit is refused or cancelled, those deported under escort, and those released from administrative detention subject to alternative obligations.
An application against a deportation decision may be made to the administrative court within 7 days of notification (Article 53/3 of Law No. 6458). Deportation decisions and the court process are explained on our Immigration Law page and in our article Deportation and Entry Bans in Turkey.
Can an Entry Ban Be Lifted?
The Presidency of Migration Management may lift an entry ban or, while keeping the ban in place, allow the person to enter Turkey for a specified period (Article 9/6 of Law No. 6458). As an entry ban is an administrative act, an action for annulment may also be brought before the administrative court within 60 days of notification (Article 7 of the Administrative Procedure Act). The case is heard by the administrative court where the authority that issued the ban is located (Article 32): Ankara if the ban was imposed by the Presidency of Migration Management, Istanbul if it was imposed by the Istanbul Governorate.
What Does an Immigration Lawyer in Istanbul Do in Entry Ban Cases?
In entry ban and deportation files, the lawyer's work starts with establishing, from the notification and the records, on what ground and by which authority the ban was imposed, since a ban linked to an overstay and a ban on public order grounds follow different rules. The deadline is then calculated, the options of applying to the authority for the ban to be lifted or bringing an action for annulment are assessed, and if a case is filed, a stay of execution may be requested.
