What Is the Difference Between the Two Claims?

The wage for time spent unemployed compensates the employee for wages lost during the proceedings and is capped by law at 4 months. Reinstatement failure compensation is a separate sanction for the employer's choice not to actually reinstate the employee, set by the judge within a 4-8 month range — the two are claimed together but assessed separately.

Application and Deadlines

The employee must apply to the employer within 10 working days of the reinstatement decision becoming final, or the dismissal may be treated as valid. The employer must then reinstate the employee within one month of that application — failing to do so gives rise to the reinstatement failure compensation.
