Izmir Civil Court of First Instance

Izmir Courthouse has a Civil Court of First Instance. It hears civil cases that the law does not assign to another court, such as compensation, inheritance and general debt claims (Code of Civil Procedure, Art. 2). Where no family, labour, commercial or consumer court has been set up, those cases are also heard here, with the court acting in that capacity.

Izmir Civil Court of Peace

Izmir Courthouse has a Civil Court of Peace. It hears all disputes arising from tenancies (rent determination, eviction and unpaid rent), actions to end co-ownership (partition) and condominium disputes (Code of Civil Procedure, Art. 4). Non-contentious matters such as certificates of inheritance and guardianship are, as a rule, also handled by the civil court of peace (Art. 383).

Divorce, Custody, and Alimony Cases: How the Process Works

Divorce cases are heard at the family court (or, where none exists, the civil court of first instance acting in that capacity). In an uncontested divorce, if the spouses agree in advance on property, alimony, and custody, the case can conclude in a single hearing; a contested divorce involves gathering evidence and hearing the parties and witnesses. The competent court is that of either spouse's residence, or the place where they lived together for the last six months.

  • Punctuality matters; failing to appear without an excuse can result in an unfavourable outcome or a postponement that lengthens the process.

Court Costs and Legal Aid in Izmir

When filing a lawsuit, an application fee, an advance fee, and an expense deposit (for notifications, expert fees, etc.) are paid; if the case succeeds, most of these costs are, as a rule, recovered from the losing party. Those without sufficient financial means may request legal aid before or during proceedings; this request is made to the relevant court with documents showing income, and if granted, provides a temporary exemption from fees and costs.
